According to report No. 458/BC-CP of the Government to the National Assembly on a preliminary review of 5 years implementing the 2013 Constitution (2014 - 2019), over the past few years the values of the Constitution, the legal system have been perfected at a higher level. Agencies have issued plans on the serious implementation of the 2013 Constitution.

Since the 2013 Constitution took effect, the National Assembly and the National Assembly Standing Committee have issued 111 codes, laws, and ordinances, including 69 documents on the attached list to Resolution No. 718/NQ-UBTVQH13; the remaining documents were issued at the request of reality; 21 documents on the list that was issued together with Resolution No. 718/NQ-UBTVQH13 have not been issued yet. In addition, the National Assembly and the National Assembly Standing Committee have also issued 35 laws and ordinances not on the List.

Relevant agencies have reviewed the entire legal system, made a list of proposals for legal documents that need to be repealed, amended, supplemented or newly issued to conform with the provisions of the Constitution. Up to now, relevant ministries and agencies have reviewed 11,786 documents. At the same time, the Government has directed a number of ministries to conduct specific reviews. According to the List issued together with Decision No. 718/UBTVQH, a total of 90 laws and ordinances are listed.

The National Assembly's law and ordinance-making program has appropriated a suitable proportion for laws and ordinances on human rights and citizens' rights.

 

 

The 2013 Constitution was born to reflect the achievements of the process of building and perfecting the legal system after nearly 30 years of conducting the renovation cause and 8 years of implementing the Strategy of building and completing legal system under the Politburo’s Resolution No. 48-NQ/TW; creating the highest theoretical and political basis for the process of building and perfecting the legal system.

In particular, some issues emerge such as promoting people's sovereignty and direct democracy; assigning, coordinating and controlling the state power; human rights and citizens' rights are recognized, respected, protected and guaranteed by the State ...

This is reflected in the legislative and ordinance making program of the National Assembly, which has given an appropriate proportion for laws and ordinances on human rights and citizens' rights.

Human rights and citizens' rights in the groups of economic and social cultural rights have been concretized in laws of economic, cultural and social fields. The Law on Enterprises, the Law on Investment, the Law on Civil Status, the Law on Citizenship Identification, the Law on Health Insurance, the Law on Social Insurance, the Law on Marriage and Family ... have been issued, amended and supplemented in a timely manner to ensure recognition and specific regulations of the mechanism and the implementation of human rights in the fields of civil, labor, marriage and family.

For the groups of human rights and civil rights in the judiciary such as the right to inviolability of the body, the right to defense of persons who are arrested, detained, prosecuted, investigated, prosecuted, judged, the rights of equality before the law ... have also been concretized in important laws such as the Criminal Code, the Criminal Procedure Code, the Civil Procedure Code, the Law on Administrative Procedure, the Law on Criminal Enforcement ...

In particular, the enactment of the Criminal Code and the Criminal Procedure Code has helped the State and people have sharper and more effective legal instruments in crime prevention and fighting, showing humanity, goodness in the crime prevention of the Party and State; at the same time, to raise the effectiveness of crime prevention in the new situation, contributing to the protection and promotion of human rights.

For human rights and citizens' rights belonging to the group of civil and political rights such as the right to stand for election and to vote; right to participate in state management, social management; voting rights when the state holds a referendum ... are also concertized through the promulgation of the new Law on Election of National Assembly and People's Council Deputies, the Law on Promulgation of Legal Documents, the Law on Referendum, the Law on Access to Information, Law on Press, Law on Beliefs and Religion ..., ensuring the legal system on human rights and citizens' rights to get better and better.

These results are reflected in the National Report on the Protection and Promotion of Human Rights of Vietnam under the Universal Periodic Review (UPR) third cycle.

Practical observations show that, since the previous review, a number of important new policies have been issued with the goal of enabling all Vietnamese people to fully enjoy human rights, especially the effort to build the constructive government, to implement Sustainable Development Goals, to ensure development rights, rights for vulnerable groups, and workers' rights.

This is an important basis for Vietnam to prepare for the next review, scheduled in 2023.

Since 2014, Vietnam has supplemented, amended or issued 96 new laws and ordinances related to ensuring human rights and citizens' rights, in accordance with the 2013 Constitution.

Some important laws passed by the National Assembly during this period include: the Law on Organization of the People's Procuracy 2014, Law on Organization of People's Courts 2014, Housing Law 2014, Criminal Code 2015, Code Criminal Procedure 2015, Law on Organization of Criminal Investigation Agency 2015, Law on Enforcement of Custody and Temporary Detention 2015, Law on Referendum 2015, Law on Online Information security 2015, Law on Belief and Religion 2016, Children's Law 2016, Press Law 2016, Law on Access to Information 2016, Law on Management and Use of Weapons, Explosives and Supporting Tools 2017, Cyber Security Law 2018, Labor Code 2019, Law on Exit, Entry of Vietnamese Citizens 2019, Education Law 2019, and Law on Criminal Judgment 2019.
